Erlanger Health System:
DOJ Alleges FMV Exceeded

On July 26, 2024, the U.S. Department of Justice filed a Complaint in Intervention against Erlanger Health System in the Western District of North Carolina. The DOJ is intervening in a False Claims Act whistleblower lawsuit filed by the defendant’s former Chief Compliance Officer and Chief Financial Officer. Like the similar complaint against Community Health Network in Indiana, this whistleblower lawsuit alleges the systematic payment of physician compensation exceeding Fair Market Value in the pursuit of downstream referrals.
